Jester Gibson & Moore, LLP’s litigation attorneys understand that most disputes ultimately are resolved by negotiated settlement, and we generally encourage our clients to explore the possibility of an early resolution before significant legal fees have been expended.
We also believe that the best possible negotiated results follow from a demonstrated willingness to take a matter to trial, and a demonstrated ability to try cases successfully. We have taken scores of cases to trial or arbitration hearing, and have established an excellent history of obtaining favorable outcomes for our clients. Our litigation practice has been concentrated in the areas of employment, commercial, and real estate litigation.
Employment Litigation
JGM has a superb track record litigating employment disputes. In a race discrimination and retaliation case, we and our co-counsel obtained the largest jury verdict in an employment case in Colorado history. Representing employees of public universities, both faculty and administrative, we have obtained seven-figure verdicts for denial of due process and deprivation of statutory rights. We have secured six-figure recoveries, both by judgment and by settlement, for executives wrongfully denied severance and sales personnel wrongly denied commissions under employment contracts. We are unusual in that we also represent employers, and have achieved success defending against claims of discrimination, wrongful termination, breach of contract, and wage and hour violations..
Commercial Litigation
JGM has successfully represented clients in a wide array of commercial disputes, including business divorces, breaches of contract, derivative actions, fraudulent inducement, and embezzlement. We have done so in state and federal courts throughout Colorado’s Front Range, and before each of the major arbitration services. Our commercial litigation practice focuses on representing closely-held Colorado companies and investors, often facing larger and better-resourced adversaries.
Real Estate Litigation
The real estate attorneys of JGM represent clients who collectively own thousands of commercial properties and hundreds of thousands of residential units. It is therefore no surprise that the litigation attorneys of JGM have considerable experience handling real-estate related litigation, from efficiently handling a routine commercial eviction to capably representing developers and promoters in connection with transactions gone bad. We understand that in order to consistently render services that are cost-effective, we need to scale our efforts to match the scope of the case.
Tort Defense
JGM frequently has been asked by its self-insured clients to defend them in negligence and other tort actions. Most often, this has consisted of accidents involving commercial motor vehicles and product liability litigation, with stakes ranging from tens-of-thousands to millions of dollars of economic losses.
